User Terms and Conditions

This Service (hereinafter defined) is made available by Sabah Credit Corporation a statutory financial body incorporated under the Credit Corporation Enactment (No.22 of 1981) having its principal office at Wisma Perbadanan Pinjaman Sabah, Pekan Baru Donggongon, Penampang, Sabah subject to the Terms and Conditions herein (“T&C”). You acknowledge that you have read and fully understood these T&C prior to your access to and use of this Service. Your activation and use of the Service constitutes your unconditional acceptance of these T&C as may be amended by SCC from time to time. Any person that you allow to access this Service using your Account shall also be bound by these T&C. If you do not agree to abide by these T&C, kindly refrain from proceeding with the registration process or activation.

INTRODUCTION

  • Through the YONO, we provide a diverse array of financial services related products and services (collectively known as “Product and Services”). Should you wish to acquire these Products and Services, you may be directed to another External Site (hereunder defined) which may contain its own distinct terms of use. By opting to proceed with the purchase of any Product and Service, you thereby consent to be bound by the specific terms of use that pertain to the particular Product and Service.
  • In the event of a conflict between these T&C and specific terms of use, the latter shall prevail. We reserve the right to amend, modify, add, delete and make corrections to these Terms of Use at any time and would recommend you to regularly review these Terms of Use and any specific terms of use periodically to stay informed about such amendments.

YONO ACCOUNT

  • Registration of Account
    1. To fully access and utilize the functionalities and features of the Platform and/or our Services, you may be required to create and register for an account with us (“Account”) by providing certain personal or business information. You hereby acknowledge and agree that we may conduct credit assessment on you including but not limited to checking with registered credit bureau or reporting agency(ies) for the purpose of accessing your creditworthiness and you agree to execute all consent form(s) or to provide additional document(s) necessary for such credit check(s) if so required by us.  
    2. You may create your Account by selecting a unique user identification of your choice subject to our ultimate approval, or a User ID will be allocated to you upon successful registration. You will be entitled to set the password and/or security code for your Account subject to specific requirements. When registering with us, you agree to provide or that such information provided to us are accurate, current and complete information about yourself, and to update that information if it changes; Failure to do so grant us  the right to close your account and/or reports created under your account within YONO. If we rely on the details provided  in your application and grand  you  user status  on YONO’s User, you irrevocably agree that you shall indemnify and keep us indemnified and hold us harmless for any expense, loss or damage that we may suffer arising from any inaccurate or false statement or misrepresentation of facts submitted by us to you.
  • Security of Account
    1. To safeguard the security of the Platform and your Account, you agree to:  
      1. Keep your password and/or security code confidential, password and/or security code when logging in;  
        • Ensure that you log out from your Account at the end of each session on the Platform;  
      2. Immediately notify us of any unauthorised use of your Account, password and/or security code;  
      3. Ensure that your Account information is accurate and up-to-date;  
      4. Use your Account strictly in accordance with the T&C published (and periodically updated) by us through online; and  
      5. Refrain from using your Account in any manner or for any purposes that could harm or jeopardize the operation, interest, reputation or goodwill of YONO. 
    2. You bear full responsibility for all activities and transactions occurring under your Account even if such activities or transactions were not committed by you.  We are neither capable nor obliged to investigate the authenticity of user’s identity or authority of such person affecting an activity or transaction. We shall not be held liable for any direct or indirect losses or damages arising from unauthorised use or access of your Account or your failure to comply with these T&C.  
    3. For enhancement and improvement purposes, we may from time-to-time conduct software evaluations to assess the performance level of the Platform and/or Services. You hereby irrevocably grant to and authorise us to conduct a periodical review of your Account, including but not limited to assessing the activities and/or transactions carried out by you on the Platform or via your Account. 
  • Identity Verification
    • We may, at times, require verification of your identity to confirm your ownership of your Account. This verification process is required for various purposes including but not limited to: 
      • Fulfilling our obligations to the relevant authorities to combat against suspicious or unlawful activities, anti-money laundering activities and the funding of terrorism;
      • Enabling us to take action when unauthorized usage of YONO accounts has been detected; and
      • Resolving any disputes relating to the ownership of a YONO account.
    • You hereby irrevocably authorise us, whether acting on our own or through our third-party service providers, to make necessary inquiries and to collect any documentation that we deemed essential to verify your identity. As part of this verification process, we shall request, and you shall provide to us, information about yourself that is true, accurate, current and complete, and can be validated through documentation that is legally recognized and accepted in the jurisdiction where such documentation is issued.

Fees for Platform Usage

  1. Unless notified otherwise in written form, we do not levy charges on Users for accessing and browsing the Platform.  
  2. We may impose fees for use of certain features on the Platform. Such fees shall be as stipulated in the Specific T&C which is specific to such feature. Please refer to the Specific T&C of the feature you intend to use for more information.

Restricted Use of YONO’s Intellectual Property and Content

  • We hereby grant you a limited and revocable licence to access and use the incidental software provided by us to you via the Platform as part of the Services. Use of such software is subject to these Terms of Use. Any third-party scripts or code, linked to or referenced from the Services, are licensed to you by the third parties that own such scripts or code. You shall not, directly or indirectly, modify the features or functionality of, copy or create derivative works using all or any portion of, analyse or remove components from, decompile, or otherwise reverse engineer or attempt to reverse engineer or derive source code, techniques, algorithms or processes from the software or permit or encourage any third-party to do so.  
  • All proprietary content, including trademarks, service marks, brand names, logos, copyrighted information and other intellectual properties (“Intellectual Property”) displayed on the Platform are the exclusive property of YONO and where applicable, third-party proprietors such as Merchants (as defined in the Specific T&C section below). No right or license, whether granted directly or indirectly to any party accessing the Platform to use or reproduce any Intellectual Property, and no party accessing the Platform shall claim any right, title or interest therein. By using or accessing the Services you agree to comply with the copyrights, trademarks, applicable intellectual property-related legislation and all other applicable laws that protect the Services, the Platform and its content. You agree not to copy, distribute, republish, transmit, publicly display, publicly perform, modify, adapt, rent, sell, or create derivative works of any portion of the Services, the Platform or its content. You also may not, unless with our prior written consent, mirror or frame any part or whole of the contents of the Platform on any other server or as part of any other website. In addition, you agree that you will not use any robot, spider or any other automatic device or manual process to monitor or copy our content, without our prior written consent (such consent is deemed given for standard search engine technology employed by Internet search websites to direct Internet users to this website).
  • Third-party links may be provided throughout the Platform. These links are provided as a courtesy only, and the sites they link to are not under our control in any manner whatsoever and you therefore access them at your own risk. We are in no manner responsible for the contents of any such linked site or any link contained within a linked site, including any changes or updates to such sites. We provide these links merely as a convenience, and the inclusion of any link does not in any way imply or express affiliation, endorsement or sponsorship by us of any linked site and/or any of its content therein.  
  • Each contributor to the services of data, text, images, sounds, video, software and other content is solely responsible for the accuracy, reliability, nature, rights clearance, compliance with law and legal restrictions associated with their content contribution. As such, we are not responsible to, and shall not, regularly monitor or check for the accuracy, reliability, nature, rights clearance, compliance with law and legal restrictions associated with any contribution of content. You shall not hold us responsible for any other User’s actions or inactions, including, without limitation, things they post or otherwise make available via the services.

Content

  • You comprehend that all content, whether publicly posted or privately transmitted, is the sole responsibility of the individual from whom such content originated. Therefore you, and not YONO are entirely accountable for all content that you uploaded, posted, emailed, transmitted or otherwise made available through or on the Platform.  
  • You acknowledge that we and our designee(s) shall have the right (but not the obligation) at our sole discretion to pre-screen, refuse, delete, remove or move any content, including without limitation any content or information posted by you, that is available on the Platform. Without limiting the foregoing, we and our designee(s) shall have the right to remove any content:
  • That violates these Terms of Use;
  • In response to a complaint from another User;
  • Upon receipt of a notice regarding intellectual property infringement or other legal directives for removal; or
  • In the event such content is otherwise considered objectionable.
  • We may also obstruct the delivery of a communication (comprising, but not limited to, postings and/ or reviews) to or from the services as part of our effort to safeguard the services and/or our Users, or otherwise enforce the provisions of these Terms of Use. You agree that you must evaluate, and bear all risks associated with, the use of any content, including, without limitation, any reliance on the accuracy, completeness or usefulness of such content. In this regard, you acknowledge that you have not and, to the fullest extent permitted by applicable law, may not rely on any content made available by us or submitted to us.
  • You acknowledge that through your access or use of the platform, you may be exposed to content that you may consider to be offensive, indecent or objectionable. To the fullest extent permitted by applicable law, under no circumstances shall we be liable in any way for any content, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of, or reliance on, any content posted, emailed, transmitted or otherwise made available on the platform.  
  • You acknowledge, consent to and agree that we may access, preserve and disclose your account information and content if required to do so by law or pursuant to an order of a court or by any governmental or regulatory authority having jurisdiction over us or in a good faith belief that such access preservation or disclosure is reasonably necessary to:
    • Comply with legal process;
    • Enforce these Terms of Use; 
    • Respond to claims that any content violates the rights of third parties;
    • Respond to your requests for customer service; or
    • Safeguard the rights, property or personal safety of YONO, its Users and/or the public.
  • You shall not, and hereby agree and undertake not to:  
    • Upload, post, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, alarming, distressing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable; 
    • Use the services to impersonate any person or entity, or otherwise misrepresent your affiliation with a person or entity;  
    • Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the services;  
    • Remove or alter any proprietary notices from the platform; 
    • Cause, permit or authorise the modification, creation of derivative works, or translation of the services without our express permission;  
    • Use the services for the benefit of any third party or any manner not permitted by the licenses granted herein or for fraudulent or illegal purposes;  
  • Use the services in a dishonest or fraudulent way to obtain any advantage, benefit or secret profit from any third party.  
  • Take any action that may undermine or manipulate the feedback or ratings systems; 
  • Attempt to decompile, reverse engineer, disassemble or hack the services (or any portion thereof), or to defeat or overcome any encryption technology or security measures implemented by us with respect to the services and/or data transmitted, processed or stored by us;  
  • Harvest or collect any information about or regarding other account holders, including, without limitation, any personal data or business information;  
  • Upload, email, post, transmit or otherwise make available any content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements); 

Disclaimers, Exclusions and Force Majeure

  • Disclaimers
    1. The platform and/or services are provided on “as is” and “as available” basis without any warranties, claims or representations made by us of any kind either expressed, implied or statutory, including, without limitation, warranties of quality, performance, non-infringement, merchantability, or fitness for a particular purpose nor are there any warranties created by course of dealing, course of performance, custom or trade usage. Without limiting the foregoing and to the fullest extent permitted by applicable law, we do not warrant that the platform and/or services or the functions contained therein will be available, accessible, uninterrupted, timely, secure, accurate,  complete or error-free, that defects, if any, will be corrected, or that the platform and/or the server that makes the same available are free of viruses, clocks, timers, counters, worms, software locks, drop dead devices, Trojan-horses, routings, trap doors, time bombs or any other harmful codes, instructions, programs or components.  
    2. Although we make every effort to secure the platform and/or services, you acknowledge and consent that the complete risk associated with accessing, using, or performing on the platform and/or the services shall remain you responsibility to the fullest extent permitted by applicable law.
  • Exclusions and Force Majeure
    1. To the fullest extent permitted by applicable law, in no event shall we be liable whether in contract, warranty, tort (including, without limitation, negligence (whether active, passive or imputed), product liability, strict liability or other theory), or other cause of action at law, in equity, by statute or otherwise, for:  
      • Loss of use;
      • Loss of profits;
      • Loss of revenues;
      • Loss of data;
      • Loss of goodwill; or
      • Failure to realise anticipated savings, in each case whether direct or indirect; and
    2. Any indirect, incidental, special, consequential, exemplary damages, arising out of or in connection with the use of or inability to use the platform or the services, including, without limitation, any damages resulting from these circumstances, even if we have been informed of the potential of such damages.  
    3. We shall not be liable for any delay or failure to perform the services, where the cause of such delay or failure is beyond our reasonable control. Such causes may include but not limited to an act of god, riot,  civil commotion, strike (whether or not involving employees of YONO),  lockout or other labour disturbance, fire, war, acts of foreign enemies, power outage, pandemics, epidemics, network congestion,  telecommunications failure, electrical power failures, or any fault,  interruption, disruption or malfunction of equipment, tools, utilities,  communications, computer (software and hardware) services or networks, government order or change in any law or regulation which renders the performance impractical.
    4. In the event that  we deem a force majeure event to be of such severity or to be continuing for such period of time that we are unable to perform any of our obligations, we shall have the absolute discretion to decide on such alternative arrangement(s), including but not limited to terminating this terms of use and/ or any specific contract or transaction (as defined in specific Terms and Conditions section below) and without liability to you other than a refund of payments for services made by you for which is not performed or unable to be performed.  
    5. You acknowledge, accept and agree that all disclaimers, exclusions and limitations of liability set out in these terms of use represent a fair and reasonable allocation of risks and benefits of the agreement between us and you, taking all relevant factors into consideration, including without limitation the value of the consideration provided by you to us and the availability and costs of insurance with respect to the stated risks. You further agree that these disclaimers, exclusions, and limitations shall be enforceable to the fullest extent permitted by applicable law.

Violation Of Terms Of Use

  • Any violation of these Terms of Use may lead to  a range of actions, including, without limitation, any or all of the following:
    1. Imposition of restriction on Account privileges;  
    2. Account suspension  followed by termination; and/or  
    3. Legal actions, including without limitation a claim for damages, specific performance and/or interim or injunctive relief.  
  • If you suspect that a User on our Platform is violating these Terms of Use, please contact us via email at [email protected] or through the communication channel(s) made available on the Platform.  

Suspension and Termination; Account Deactivation and Closure

  • You consent to our sole discretion to suspend or terminate your account, with or without notice, and without any liability to you or any third party, as well as to remove or delete any content associated associated with your Account, or subsidies offered to you. We may also cancel any transaction associated with your Account, temporarily disable your access to any or all of the services and/ or features on the Platform, retain any and all sale proceeds or refunds (as the case may be), and/or take any other actions that we deem necessary. Typical reasons for such actions may include, but not limited to:  
    1.  Inactivity of the Account for a consecutive period of twelve (12) months;  
    2.  Possession of multiple user accounts or allowing unauthorised persons to access and use the Account;  
    3. Our reasonable belief that there is dishonesty, suspected fraud, illegality, criminality or misrepresentation in your conduct on your account or your use of the platform and/or services;  
    4. Breach of these T&C or reasonable grounds to believing that you have breached these T&C and/or any applicable terms and conditions as may be provided by us from time to time, or have engaged in any conduct prejudicial to YONO or in our opinion, your acts are prejudicial to YONO’s interest;  
    5. Violation of any acts, statutes, laws, by-laws, rules, regulations, guidelines and/or policies imposed by any authority, regulatory body or government agency;
    6. Acting in bad faith or with malicious intent, or conduct we reasonably believe to be harmful, defamatory, or abusive toward other Users, third-parties and/or YONO;  
    7. Your name is listed under any regulatory watch list (including but not limited to listing related to terrorism and terrorism financing) under the applicable laws governing anti-money laundering, anti-terrorism financing and/ or corruption and/or such other local, foreign or international laws and regulations of similar nature;  
    8. A court order or directive from a relevant governmental or regulatory authority necessitates such action;  
    9. Submission of false documents or  provision  of false information during your registration with or application to us; and/or  
    10. Failure to provide any additional information requested by us from time to time for verification purposes.  
  • The use of the platform, services and/or an account for purposes that are suspicious, fraudulent, illegal, harassing, defamatory, threatening or abusive may be reported by us to the relevant law to the appropriate law enforcement authorities without prior notice to you.  
  • In the event that we suspend your account, our services and/ or any specific features to you pursuant to Clause 9.1 above, we shall have the right to commence an investigation into such event and shall have the absolute right to disable your utilisation of any or all services and/or hold back any and all refund or money or benefit due to you (as the case may be) until and unless clearance has been obtained from the relevant authorities and/or the satisfactory completion of any investigation. 
  • In the event your access and/or utilisation of the platform and/or services is suspended, ceased or terminated by us due to suspicious, fraudulent, illegal or unlawful transactions including but not limited to breaches of any law or any rules, regulations, policies and/or guidelines made thereunder), you will not be able to continue to utilise any or all services and shall not be entitled to obtain any money or refund or benefit whatsoever. We have the right to retain for such funds, refunds or benefits indefinitely, or to handle them at our discretion, or to release them to the relevant authorities, in accordance with applicable legislation, rules, regulation and/or guidelines. You shall not be entitled to make any claim for compensation for any losses resulting from such actions. 
  • Upon termination of the account due to any reason whatsoever, any outstanding payments due by you to us and/or merchant shall become immediately due and payable. 
  • Any provision of these T&C which expressly or by implication is intended to continue to remain effective and binding on the user after the termination of account and/or the termination of services, such as provisions concerning the user’s warranties, undertakings and indemnifications to us, shall survive such termination.

DELETION OR CANCELLATION OF ACCOUNT

  • You may request to delete or cancel your YONO Account at any time. You may do so through our app (Home > Account > Profile Details > Delete my account) or by contacting us at our email address [email protected].
  • Once an account is deleted, you may choose to reactivate the account within the 14 days grace period.
  • Please note that once your account is deleted, you will not be able to use our products and services thereafter.

User’s Representations and Warranties

  • By accessing the platform, using the services and/or registering an account with us, you irrevocably represent and warrant to us that: 
    1. You possess the legal capacity (and in the case of a minor, valid parent or legal guardian’s consent), right and ability to accept and enter into these T&C and to comply with all the T&C contained herein; 
    2.  If you are representing and acting on behalf a corporate body, you possess the full authority, capacity, right and ability to accept and enter into these T&C on behalf of the corporate body and to comply with all the terms and conditions contained herein;  
    3. Any and all information and documentation you provided or submitted to YONO for whatsoever purposes are and will remain true and not fake, accurate, not misleading, complete and up-to-date;  
    4. You will access and use the platform and/or services for lawful purposes only and in accordance with these T&C and all applicable laws, rules, regulations, codes, directives, guidelines and policies in force from time to time; and  
    5. If so required, you will make yourself available to, and to render full cooperation and assistance to YONO and/or the relevant authorities concerning any pending and future contentious matters, audits or investigations (including investigations commenced pursuant to Clause 9 above) arising out of or in connection with your account or use of the platform and/or Services in order to ensure that such matters or investigations can be resolved amicably and efficiently. 

Indemnity & Limitation of Liability

  • The content on YONO is provided on an “as is” and “as available” basis. You therefore agree that your use of YONO and the products and services offered for sale on the Mobile App are provided at your sole risk. YONO, our officers, directors, employees, partners and suppliers disclaim:
    1. All warranties or representations of any kind regarding this Mobile App, its operations or the accuracy, reliability, completeness, usefulness, non-infringement of intellectual property rights, or quality of any information, content or material included herein;
    2. To the fullest extent permitted by applicable laws, all conditions and warranties, express and implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose or non-infringement;
    3. All liability to you or anyone else for any direct, indirect, special, consequential or punitive loss or damage (including without limitation loss of revenue, loss of goodwill, loss of reputation and loss of, or damage to, data), incurred or suffered in connection with the use or inability to use this website whether based in contract, tort or otherwise even if we are informed of their possibility; and
    4. All liability to you or anyone else if interference with or damage to your computer systems occurs in connection with use of this website or an external site. You must take your own precautions to ensure that whatever you select for use from this Website is free of viruses or anything else that may interfere with or damage the operation of your computer systems
  • In the event of any third-party request, loss, liability, proposition, or expense (including lawyer’s fees) brought against YONO arising from or relating to your usage of this website and/or the products and services, you agree to defend, indemnify and hold us, our directors, employees, agents, partners, affiliates and other licensed persons, harmless at all time.

Governing Law and Jurisdiction

  • These Terms of Use shall be governed by and construed in accordance with the laws of your jurisdiction without regard to the conflict or choice of law principles.  
  • Any dispute, legal action or proceeding arising out of or in connection with these Terms of Use shall be submitted to the jurisdiction of the courts in your jurisdiction unless YONO in its own discretion chooses to submit the same for settlement via arbitration in your jurisdiction or otherwise.

Specific T&C - YONOPAY

  • Introduction
    1. We have developed and own a cashless payment mechanism named “YONOPay” that allows you to make cashless payments to the Merchant via YONOPay.  
    2. YONOPay supports payments made on the platform via Credit / Debit card, online banking, selected electronic wallet (e-wallet) or other payment method as may be accepted by us from time to time.  
    3. Your usage of or transaction carried out on YONOPay is additionally governed by these specific T&C – YONOPay.  
    4. The service is made available to you by YONOPay at its sole and absolute discretion to enable you to perform the Transaction.
    5. To make use of the Service, you are required to activate the YONOPay e-wallet within your YONO and create an account. Upon the creation of the Basic Wallet account, you will have an account Limit of Ringgit Malaysia Five Hundred (RM500.00) only.
  • Basis of the YONOPay transaction
    1. YONOPay transactions are made after you have received your goods and/ or services from the Merchant.  
    2. All transactions conducted through YONOPay are directed and initiated by you and are not under the control of YONO. In particular, the final price shall be the amount specified and input by you onto our platform. We shall not bear any liability or responsibility for losses of any kind that you may incurred as a result of your failure to input the correct final price.  
    3. Our role primarily entails facilitating your cashless payments at the Merchant’s participating outlet, whether online or at the physical store, through YONOPay. We serve as the host, maintainer and enabler of transactions between you and merchants via the internet.  
    4. In relation to your selected payment method, you represent and warrant being an authorised holder of the selected and eligible Credit / Debit card, online banking, selected electronic wallet (e-wallet) or other payment methods as may be accepted by us from time to time (“Payment Method”).  
    5. You may upgrade to Premium Wallet with Account Limit of Ringgit Malaysia Ten Thousand (RM10,000) only by successfully completing the Account Verification (eKYC) process. 
    6. by completing the Account Verification (eKYC) process, you acknowledge that YONO may use the relevant Personal Information/Data for identity verification and/or authentication purposes.
    7. In the event of any issues with the Account Verification (eKYC) function, kindly contact the YONO Support number for assistance.

  • Payment method and cancellation 
    • In the event of a transaction, the payment process involves 
      • Credit card/debit card / online banking/e-wallet information is held and 
      • The price of the transaction is charged to the selected payment method immediately.
    • To fully utilize YONOPay, You are required to provide a current, valid and accepted payment method which may be subjected to periodic updates. 
    • Cancellation of payments made through YONOPay by you is not permitted. However, you may contact the Merchant to request for a cancellation or termination. In the event of cancellation by the Merchant, we shall refund final price (minus any handling fee or administrative charge chargeable at YONO’s discretion) made by you. In the event of a partial cancellation by the Merchant, we shall refund the portion of the final price (minus any handling fee or administrative charge chargeable at YONO’s discretion) as instructed by the Merchant. All refund or partial refund shall be made through the original payment method chosen by you and may take up to 14 business days to process. To facilitate the refund process, you shall ensure that the payment information and/or details are accurate as the default refund method depends on your original payment method. 
    • If a selected payment method fails to complete a transaction, we reserve the right to request and/or obtain payment from you through other avenues. Payment method may be changed at the “Payment” page on the platform. In the situation whereby a payment transaction is unsuccessful due to whatever reason, you are recommended to change the pre-selected payment method to ensure a subsequent payment can be successfully transacted, failing which will result in allowing us the authority to continue billing you based on the pre-selected payment method. For the avoidance of doubt, any concern, dispute or query in respect of the use of a selected payment method shall be resolved between you and the relevant financial institution, credit/debit card issuer and/or e-wallet operator. 
    • By using YONOPay, you irrevocably acknowledge and agree that we may use all information, including personal and billing information, provided to us in the course of using the Services (“Payment Instructions”). You acknowledge and agree that it is your sole responsibility to ensure that all your Payment Instructions are correct, complete and accurate in every respect and you understand that time is required to process your Payment Instructions. The payment instructions provided by you will be treated as final and we are not obliged to verify the Payment Instructions with you. Further, by providing us with your payment instructions, you agree to pay or authorise us to deduct from your account all fees and charges associated with your payment instructions. For the avoidance of doubt, any concern, dispute or query in respect of Payment Instructions or the functionality of a selected payment method shall be resolved between the user and the relevant financial institution, credit/debit card issuer and/or e-wallet operator. 
    • We shall not be responsible and will not assume liability for any losses and/or damages to you arising from wrong information and details, including payment information and/or card details, entered by you or wrong remittance by you in connection with the payment for the purchase of a merchant offering. We reserve all rights to verify whether you are duly authorised to use a certain payment method and we may suspend a payment transaction until such authorisation is confirmed or cancel such relevant transaction where such confirmation is not available.

External and Third Party Sites

  • This Mobile App may contain links to websites maintained by third parties (“External Sites”). These External Sites are provided to redirect you to another website to facilitate the purchase of Products and Services, or for your reference and convenience only. 
  • YONO either operates controls or endorses in any manner these External Sites or their content. You are solely responsible for the use of these External Sites and are therefore, it is advised that you carefully review the terms and conditions of these External Sites.

YONOPay

INTRODUCTION

  • These terms and conditions (“Terms and Conditions”) shall govern all matters regarding payment made by way of the YONOPay payment method and shall be the legally binding document between you and Borneo Integrated Pay Sdn Bhd (“BIPSB, us , our, we”) a subsidiary owned by Sabah Credit Corporation (“SCC”).
  • YONOPay is an electronic wallet platform (“YONOPay”) that allows you to make and conclude payments for products and services offered by BIPSB (“Transaction”) via (a) mobile application (“App”) owned and operated by BIPSB and (b) point-of-sale terminals or readers of participating merchants, provided always that all payments are not in violation of this Terms and Conditions.
  • By virtue of you making a Transaction via YONOPay (“YONOPay Transaction”), you are deemed to have read, understood and expressly agreed to be bound by these Terms and Conditions, the Terms of Use and Privacy Statement of BIPSB which may be amended, modified, added, deleted, and corrected at any time. Therefore, we would advise you to review these Terms and Conditions periodically to be aware of such changes. Further, you agree and accept that the updated Terms and Conditions shall supersede all previous version of Terms and Conditions with automatic effect once they are posted on our App, without any further action by us and that you shall be bound by the terms of the most recent version of the Terms and Conditions found on the App.
  • YONOPay is developed and managed by and Borneo Integrated Pay Sdn Bhd (“BIPSB”) a subsidiary owned by Sabah Credit Corporation (“SCC”). Therefore, you further acknowledge and accept that you will be bound by additional terms and conditions of YONOPay, if any, in respect of the decelopment and/or management of YONOPay by BIPSB from time to time. 
  • YONOPay is a white label e-wallet operated by Fass Payment Solutions Sdn Bhd, a third party system provider (“Settlement Partner”) approved and licensed by Bank Negara Malaysia to issue electronic money pursuant to Section 11 of the Financial Services Act 2013. Therefore, you further acknowledge and accept that you will be bound by the Terms of Use and Privacy Policy of our Settlement Partner.

Creation and Use of YONOPay

  • To create YONOPay account you must;
    1. be of or over eighteen (18) years of age and have full capacity to fulfil any Transaction.
    2. You must be Malaysian or reside in Malaysia;
    3. provide us with information by clicking in the “YONOPay” icon for account registration including but not limited to, personal information, providing personal identification documents and mobile phone number for account registration, activation, security and identify verification purposes, and to update your personal information in the App from time to time to ensure it is accurate and current.
  • YONOPay mobile application is available on Apple iOS, Android and Huawei AppGallery. The Mobile App comes with touch ID and a password (“PIN”).
  • To activate your Account, a one-time password (OTP) will be sent to the mobile phone number you used to register and you will be required to go through a one-time secure authentication process and create a password (“PIN”) that allows you to access your Account.

  • Upon authentication, you may proceed to perform the eKYC on your Account to enable you to upgrade to a Premium account so you can perform the unlimited transaction.
  • YONOPay offers two types of accounts options; Basic and Premium. A Wallet user account will be designated as ‘Basic’ if the user selects this option. To subscribe for a “Premium” Wallet, you must provide your residential address and undergo a Know Your Customer (‘KYC’) process to ensure compliance with all relevant legislation and regulations. Additionally, You may be require to provide identification image that must match the information  on your registered IC. YONOPay reserves the right to request additional document or information in the future. Please be aware that YONOPay maintain the full discretion to refuse, reject and/ or decline your application without the obligation to provide any reasons of the decision.  YONOPay determination in this regard shall be considered final and conclusive. 
  • An overview of the YONOPay e-wallet sizes and its limitations are as follows:

Payment, Top-Up, Withdrawal and Refund

Payment
  • You may choose to add any credit cards or payment cards or online banking to transfer funds into your YONOPay account as are made available in the Application (“Funding Source(s)”) including the debit of your YONOPay account using funds in your Bank Account. 
  • You agree to verify and authorised the Funding Source details when you first register the Funding Source with us in connection with your use of YONOPay. In the case of credit cards as Funding Sources, you agree that we may issue a reasonable authorisation hold, which is not an actual charge against your credit card, in order to verify your payment method through your credit card. The authorisation hold may appear in your statement as “pending”. The authorisation hold is issued as a preventive measure against any unauthorised or fraudulent usage of your credit card. In the event your payment through YONOPay using a credit as your Funding Source is processed overseas, you shall be liable for any additional charges in relation thereto.
  • You hereby understand and acknowledge that upon linking or binding your credit and/or debit card to the Account, you shall be solely responsible and liable for all Reload(s) that may occur.
  • You may transfer funds into your account at any time, up to maximum wallet limit for Basic Account and RM8,000 for Premium Account. (“Wallet limit”).
  • The maximum daily transaction limit is RM1,000 for Basic Account and RM10,000 for Premium Account. Upon reaching the maximum daily transaction limit for either Basic or Premium users (“Transaction Limit”), you will be required to choose and make payment for the remaining amount through an alternate payment method.
  • You are responsible to ensure that there is sufficient balance in your Account before proceeding to pay through YONOPay for the total cost of the transaction.
  • Subject to the Transaction Limit, you are liable for the full amount of the payment due plus any applicable fees.
Top-up
  • You agree that when you directly add funds to your YONOPay account using online banking or any cards payment, you confirm that you are legally authorized to access the bank account you have used.
  • Funds deposited into your Account shall not accrue interest or any sort of earnings.
Withdrawal
  • Basic account user is not allowed to perform withdrawal. 
  • You are entitled to request a withdrawal of the funds available in your YONOPay account, with  the condition that you have  no pending withdrawal request. Such withdrawal can only be made to your own bank account, held with a local banking institution, and  further subject to meeting  the minimum balance requirement in your YONOPay account. Fasspay reserves the right to impose a withdrawal fee of Ringgit Malaysia Two (RM2) for each withdrawal request, with such charges being deducted from your YONOPay account.
Refund
  • In the event any selected merchant(s) may provide a refund option in relation to the payment for any purchase of goods and/or services in accordance with its after-sale service policy, such refund shall be subject to the following:
    • The refund process shall be subject to the merchant’s refund policy and any terms and conditions imposed on such refunds;
    • Your Account must be active; and
    • You are aware that we may contact you through your mobile device, through email or automatic phone calls or text messages, for any purpose regarding your YONOPay account, including but not limited to top-up notification, refund notification, account servicing and request for one-time password (OTP).

DORMANT ACCOUNT

  • In the event of no transaction occurring on your Account and/or you have not logged into your Account for a consecutive period of (12) months, your Account shall be suspended and  categorised as a dormant account. 
  • In the event you intend to reactivate your Account, you may do so as follows:
    1. In the case of an account suspension due to inactivity, you shall be obligated to reload your Account with any amount using the available reload channels; and
    2. In the case of an account being blocked due to inactivity: You will be required to contact us for reactivation of your YONOPay account.
  • An annual dormant fee of Ringgit Malaysia Five (RM5) shall be imposed for every consecutive period of seven years or which will be deducted from your Available Balance for so long as your Account remains inactive or until the balance in your YONOPay account depleted, whichever occurs first. The annual dormant fee is non-refundable once it has been imposed and deducted from your Account.
  • Any remaining balance in your Account after a period of seven (7) years of dormancy shall be transferred to the Registrar of Unclaimed money or in whatever way as provided in the Unclaimed Money Act 1965.

USER OBLIGATION (YOUR RESPONSIBILITIES)

  • You hereby agree to provide YONOPay with accurate, authentic, current and complete information as may be demanded , and your bear  the responsibility to maintain and  promply update your information to ensure its accuracy, currency, authentication and completeness at all times.
  • You shall provide us with proof of identity as YONOPay may reasonably request or require. You explicitly acknowledge and agree that only one (1) YONOPay account can be registered per one (1) mobile number. 
  • You bear the responsibility of securing your mobile device to prevent  unauthorized access to your Account. You expressly agree to assume responsibility for all the e-wallet transaction, regardless of whether they are authorized by you.
  • You shall undertake all necessary measures to ensure, and you hereby agree:- 
    1. not to leave your mobile device unattended while logged-in into the App and commit to logging off immediately at the end of each session;
    2. to keep your App’s password confidential and secured; and
    3. to immediately inform us if you have any reason to believe that your Account’s PIN has become known to a third party.
    4. You shall bear responsibility for all YONOPay Transactions conducted through your designated Account, whether or not such transactions were carried out with your authority, knowledge or consent. You may not make any claims against us in connection with any such use or purported use of your account.

PRIVACY

  • You hereby acknowledge, agree and consent to YONOPay collecting, using, processing and disclosing the Personal Data provided by you in accordance with the Data Privacy Policy (as may be amended from time to time), which is incorporated by reference to this Clause, and sets out: –
      1. What Personal Data we collect;
      2. How Personal Data is collected;
      3. What we use Personal Data for;
      4. Who we disclose Personal Data to;
      5. Overseas transfer of Personal Data;
      6. Protection of Personal Data;
      7. Retention of Personal Data;
      8. Your rights with respect to your Personal Data;
      9. Amendments and updates; and
      10. How to contact us if you have any queries about the Data Privacy Policy or would like to exercise your rights as set out in the Data Privacy Policy.
  • Any consent you give pursuant to these Terms in relation to your Personal Data shall survive your death, incapacity, bankruptcy or insolvency as the case may be, and the termination of these Terms.

TERMINATION AND SUSPENSION

  • YONOPay shall be entitled to immediately suspend or terminate your use of Service (or any part thereof, including any benefits under the Service) and your access to the Account, or to take any approriate action as deem fit by YONOPay, with or without prior notice to you, in the event of any of the following occurences:-
    1.  Deceased; or
    2.  if you have used your Account or the YONOPay wallet outside its intended use, including but not limited to, using your Account or YONOPay e-wallet primarily for cashing out such as (i) using the YONOPay e-wallet as a medium to facilitate withdrawal of money from your credit card, directly or indirectly; or 
    3.  if you are in breach or YONOPay have reasonable grounds to believe that you have breached any of the provisions of the provisions outlined in the Terms and Conditions, the terms and conditions of any applicable terms and conditions of any new services as may be provided by YONOPay from time to time, or have engaged in any conduct detrimental or acting or attempting to act any illegal activities or anything related to infringement or violation of any law of the Malaysia or carrying out an act that consisting  to YONOPay or if in the opinion of YONOPay, your actions are detrimental to YONOPay’s interest;
      1. if you are in breach of any acts, statues, laws, by-laws, rules and/ or regulations imposed by any party, regulatory body or government agency;
      2. if you have submitted false documents or have declared false information during your application for the Service;
      3. if you have acted in bad faith or with malicious intent
      4. if you have been blacklisted by any financial institutions, licensed bank or e-money issuers in Malaysia or abroad;
      5. if you are included in our internal watch lists;
      6. if your name is listed under any regulatory watchlist (including but not limited to listing related to terrorism and terrorism financing under the AMLATFPUAA);
      7. if you are included in the Specially Designated Nationals (SDN), politically exposed persons (PEP), or relatives or close associates of PEPs (RCA) lists or other relevant money laundering and terrorism financing information sources, watch- lists, or related databases maintained or provided by both domestic or foreign authorities from time to time, including but not limited to, Bank Negara Malaysia (BNM), United Nations Security Council Resolutions (UNSCR), Office of Foreign Assets Control (OFAC), and the Financial Action Task Force (FATF);
      8. if you or your Account has been detected for money laundering, terrorism financing, fraudulent, illegal and other suspicious activities; and/or
      9. if you fail to provide any additional information which YONOPay may request from you from time to time.
    4. Upon termination , the following actions shall take place;
      1. Cancellation of any pending transactions: In the event of termination, all pending transactions shall be subject to immediate cancellation. Notably, if any such transactions pertain to the purchasing of goods or services, theses shall be effectively voided.
      2. Disabling of Offline Token: Following termination, any offline tokens that have been assigned to your YONOPay account will be immediately disabled.
      3. Disabling of Linked Credit or Payment Cards: Any credit cards or payment cards which you have linked to your YONOPay account will be disabled.
    5. You may, at any time, terminate the Service by giving notice of such termination via the Mobile Payment App only. If you have any Available Balance in the Account, you must ensure that you provide to YONOPay the correct bank account details and any other information as may be required by YONOPay to enable the process the termination of the Service and refund the Available Balance to your bank account within fourteen (14) working days. If you do not have any Available Balance in the Account, the Service shall be deemed to be terminated immediately upon receipt of the termination notice by YONOPay via the Mobile Application, or the desktop Application (As and when made available by the Parties with or without prior notice to you)

LIMITATION OF LIABILITY

  • BIPSB shall not be liable or responsible to keep the app virus, bug, ransomware, trojan, work, malware, spyware free or safe and you agree and confirm to use the app solely at your own risk and expense.
  • You agree and confirm that the BIPSB:-
    • does not provide any express or implied warranties such as implied warranties terms or representations of merchantability, fitness for a particular purpose and non-infringement. BIPSB does not provide any guarantee that this app will always be available, uninterrupted, complete, accurate, reliable, timely, safe, secure or error-free, or that this website will always functions without disruptions, delays or imperfections, or are free of all defects, errors, viruses or bugs; and/or;
    • is not liable for any failure or delay to perform the BIPSB’s obligations under this terms and conditions where the failure is due to anything beyond BIPSB’s control.

INDEMNITY

  • You shall indemnify and shall keep indemnified YONOPay from any loss, damage, liability or expense, arising from any claims for libel, invasion of privacy, infringement of copyright, patent, breach of confidence or privilege or breach of any law or regulation whatsoever arising from the breach of these Terms and Conditions, the use of the Account and Service, content transmitted, received or stored via the Service or part thereof and for all other claims arising out of any act or omission of your or any unauthorised use or exploitation of the Services or part thereof.
  • You hereby agree to fully indemnify and to hold YONOPay harmless from and against any claim brought by a third party resulting from your use of the Account, Service and in respect of all losses, costs, actions, proceedings, claims, damages, expenses (including reasonable legal costs and expenses), or liabilities, whatsoever suffered, or incurred directly or indirectly by YONOPay in consequence of such use of the Account, Service, and/or your breach or non-observance of any of these Terms and Conditions and/or any applicable terms and conditions of any new services which YONOPay may provide from time to time.
  • You shall defend and pay all costs, damages, fees (including any reasonable legal fees) and judgements awarded against YONOPay arising from the above claims, and shall provide YONOPay with notice of such claims, full authority to defend compromise or settle such claims, and reasonable assistance necessary to defend such claims, at your sole expense.

GOVERNING LAW

  • These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia, and you hereby submit to the exclusive jurisdiction of the Malaysian courts.

FORCE MAJEURE

  • Notwithstanding any other provision in these Terms and Conditions, YONOPay shall not be held liable for any failure to perform its obligations herein caused by occurrence of a force majeure event, which includes but is not limited to acts of God, insurrection, civil disorder, military operations or act of terrorism, all emergency, acts or change of Government, or any competent authority, riot or industrial disputes of any kind, fire, lightning, subsidence, explosion, floods, lock-down, pandemic,epidemic  acts or omission of persons or bodies for whom YONOPay has no control over or any cause outside YONOPay’s reasonable control.
  • The Service may occasionally be affected by interference caused by objects beyond YONOPay’s control such as buildings, underpasses and weather conditions, electromagnetic interference, equipment failure or congestion in Mobile Payment System. In the event of such interference, YONOPay shall not be responsible for any inability to use or access the Service, interruption or disruption of the Service.

AMENDMENTS TO THE TERMS OF USE

  • We may, in our sole discretion, amend, revise, vary, modify or update the Terms of Use and suspend or cancel your YONOPay account or your eligibility to use your YONOPay account at any time. By your continuous use of the Service of YONOPay, you are deemed to have read and agree to any such amendment, revision, variation, modification or update to the Terms of Use. 
  • YONOPay shall give you at least twenty-one (21) days prior notice through email or through the Services before any variation of this Terms of Use.

ANTI-MONEY LAUNDERING, ANTI-TERRORISM FINANCING AND PROCEEDS OF UNLAWFUL ACTIVITIES ACT 2001 (AMLATFPUAA) & FINANCIAL SERVICES ACT 2013 (FSA)

  • YONOPay acknowledges that the document or information collected by YONOPay from you relating to your affair or account as a customer of YONOPay will be only used and/or disclosed in accordance to the secrecy provisions under the Financial Services Act 2013 (FSA).
  • YONOPay, its subsidiaries and officers shall comply in all material respects with the all applicable laws, regulations, guidelines and policies relating to AMLATFPUAA, including all, Regulations and Rules.
  • Without limiting the generality of the foregoing, to the extent required by the AMLATFPUAA, YONOPay shall;
    • maintain an anti-money laundering and anti-terrorism financing compliance program that is in compliance, in all material respects, with the AMLATFPUAA;
    • conduct, in all material respects, the due diligence required under the AMLATFPUAA in connection with the use of the Account, including with respect to the origin of the funds used by you to reload into the Account and;
    • maintain sufficient information to identify you for purposes of compliance, in all material respects, with the AMLATFPUAA.
  • In the event your Account is ceased, terminated or suspended by YONOPay due to fraudulent, illegal or unlawful transactions including but not limited to breaches of any law (including but not limited to the Financial Services Act 2013 and/or AMLATFPUAA or any regulation and/or guidelines made thereunder), you shall not be entitled to obtain any refund of the monies and all reload monies whatsoever in the Account and it shall be lawful for YONOPay to retain for an indefinite period or release to the relevant authorities all monies in the Account in accordance with applicable legislation, regulation and/or guidelines. You shall not be entitled to claim any form of compensation for any loss arising therefrom from YONOPay.

INTELLECTUAL PROPERTY RIGHTS

  • All image, logo trademarks or tradename and other intellectual property rights used in relation to the Services belong to YONOPay.
  •  You acknowledge and agree that all trademarks and other intellectual property rights relating to the   Services or any part thereof, whether presented to you by YONOPay, advertisers or any third party are protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws and all YONOPay’s rights therein are expressly reserved.
  •  You hereby agree not to exploit the intellectual property rights of YONOPay or its settlement Partner. Further, you are prohibited from perform or allow any third party to perform any action that might cause damage to the image, logo, trademarks or tradename or other intellectual property rights (IPR), of YONOPay or its settlement partner.

SERVICE OF NOTICE

  • YONOPay may, in its sole discretion, serve you notice under these Terms and Conditions by posting such notice on the YONOPay’s mobile application or desktop application or any other online or other medium, which YONOPay may introduce from time to time.

SEVERABILITY AND EFFECT OF TERMS AND CONDITIONS

  • If any of the provisions herein contained should be invalid, illegal or unenforceable under any applicable law, the legality and enforceability of the remaining provisions shall not be affected or impaired in any way and such invalid, illegal or unenforceable provision shall be deemed deleted.

WAIVER

  • YONOPay’s failure to exercise any particular right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision, unless acknowledged and agreed to by YONOPay in writing.

ASSIGNMENT

  • You shall not assign or in any other way transfer your rights or obligations under these Terms and Conditions or part thereof. YONOPay may assign these Terms and Conditions in whole or in part to any third party at its discretion.

BINDING EFFECT

  • These Terms and Conditions shall be binding upon Your successors and permitted assigns. These Terms and Conditions shall be binding upon and ensure to the benefit of YONOPay’s respective successors in title and assigns.

YONO for Education Incentive Campaign

INTRODUCTION

  • This Campaign is held by Borneo Integrated Pay Sdn. Bhd. (Company No. 202101027893 / 1428193- H) (“BIPSB”). By participating in the Campaign, Customer (as hereinafter defined) hereby agrees to be bound by these terms and conditions which shall form an integral part of and to be read together with YONO Terms and Conditions, and YONOPay Terms and Conditions.
  • In the event of a conflict or inconsistency between these terms and conditions, such inconsistency shall be resolved by giving precedence in the following decreasing order (i) these terms and conditions; (ii) YONO Terms and Conditions; and (iii) YONOPay Terms and Conditions.

Campaign Period

  • 2 May 2024 until 15 November 2024 (both dates inclusive) or such other dates as may be determined by BIPSB from time to time with prior notice to you.

Eligibility

  • This Campaign shall be applicable to selected YONO users only (“Customer(s)”) who, during the Campaign Period, have successfully: –
    1. registered with YONOPay e-wallet as a user; and
    2. upgrade from Basic Wallet to Premium Wallet no later than the Campaign Period.
  • For clarity, selected YONO Users are user(s) who, during the Campaign Period, are in BIPSB’s database as official personnel from the Jabatan Pendidikan Negeri Sabah.

Campaign Mechanics

  1. Eligible Customer (who fulfills the Eligibility criteria set out in paragraphs A and B above) during the Campaign Period, will be eligible to receive a one-off cash incentive of RM10 (“RM 10 Cash Incentive”).

    For clarity, in addition to the RM10 Cash Incentive that eligible Customer(s) may receive under this Campaign, they are eligible to participate in and may receive rewards as may be determined by BIPSB from time to time (terms and conditions apply).

  2. Subject to availability, the Incentive will be credited immediately into the eligible Customer’s Gift Card in their YONOPay E-wallet upon successful fulfilment of the criteria set out in paragraph A and paragraph B above.
  3. Subject to paragraph 2 above, Eligible Customer will receive notification after the RM10 Cash Incentive has been credited into their YONOPay e-Wallet Gift Card upon fulfilment of paragraphs A and B above.
  4. For clarity,:
    • Each eligible Customer may only receive and utilize a maximum of one (1) Incentive under this Campaign; and
    • BIPSB reserves the sole and absolute right to withdraw, amend, omit and/ or vary any part or the whole of the terms and conditions of this Campaign without prior notice and Customer(s) shall be bound to observe, perform and comply with the terms and conditions hereinabove set out and any amendments thereof

YONO Referral Campaign

INTRODUCTION

This Campaign is held by Borneo Integrated Pay Sdn. Bhd. (Company No. 202101027893 / 1428193- H) (“BIPSB”). By participating in the Campaign, Customer (as hereinafter defined) hereby agrees to be bound by these terms and conditions which shall form an integral part of and to be read together with YONO Terms and Conditions, and YONOPay Terms and Conditions.

  1. In the event of a conflict or inconsistency between these terms and conditions, such inconsistency shall be resolved by giving precedence in the following decreasing order (i) these terms and conditions; (ii) YONO Terms and Conditions; and (iii) YONOPay Terms and Conditions.

Campaign Period

  1. 25 October 2024 until 27 October 2024 (both dates inclusive) or such other dates as may be determined by BIPSB from time to time with notice to you.

Eligibility

  1. This Campaign shall be applicable to all YONO mobile application (“YONO SuperApp”) users (“Eligible Customer”).
  2. An Eligible Customer who participates in this Campaign and introduces contacts or business associates to BIPSB shall be referred to as “Referrer”, and referee shall be referred to as “Referee”.

Campaign Mechanics

  1. For each Successful Referral of a new YONO user who has fulfilled the criteria in paragraph 6 below, both the Referrer and Referee may each receive an Introductory Referral Reward of RM5 (“Referral Reward”).
  2. The following conditions must be met (“Successful Referral”) for both Referrer and Referee to
    be entitle to receive the Referral Reward under this Campaign: –
    (a) The Referrer must be an existing registered YONO SuperApp user;
    (b) Use the eligible Referrer’s invitation code during registration on YONO mobile application;
    (c) The Referee is not already an existing registered user of the YONO SuperApp at the date of the referral;
    (d) Referee can only be referred to BIPSB once. In the event that a Referee is referred to BIPSB more than once, only the first person to refer the Referee to BIPSB may be eligible for the Referral Reward under this Campaign; and
    (e) The Referee must make a spending of at least RM20 in a single receipt at any YONO Merchant / YONO SuperApp in-apps Merchant during the Campaign Period.
  3. Under this Campaign, the Referral Reward is limited to the first 1,000 Successful Referrals only, on a first come, first serve basis
  4. The Referrer represents, undertakes and confirm to BIPSB on the following: –
    (a) The Referrer has obtained expressed consent from the Referee(s) to disclose his/her personal data to BIPSB;
    (b) The Referrer has confirmed that the Referee(s) has/have no objection to BIPSB to contact them for the purpose of cross-selling, marketing and promoting BIPSB’s products and services (if any); and
    (c) The Referrer agrees and consent for his/her name to be disclosed to the Referee(s) upon their request for the purpose of this Campaign.
  5. In the event that the Referee(s) name is/are introduced by more than one (1) Referrer(s) or there is a duplication of submission of the Referee(s) information in the Campaign, the first who submits the Referee(s) information will get the Referral Reward, determine by date and time, on first come first serve basis.
  6. BIPSB shall at its discretion be entitled to forfeit the Referral Reward if information provided by Referrer is incorrect or invalid or after three (3) attempts to contact the Referrer via their contact details maintained with BIPSB.
  7. Referrer is not entitled to any form of payment or compensation from BIPSB should their Referral Reward be forfeited for whatever reason BIPSB may determine.
  8. The Referral Reward is not transferrable to any third party, and is not exchangeable for physical cash, credit cheque or any other items in kind.
  9. This Campaign is not a contract of service or employment or a partnership or joint venture agreement with the Eligible Customer and the Eligible Customer shall not at any time describe themselves as an agent or representatives of BIPSB or represent BIPSB in any manner save and except to refer customers to BIPSB for the purposes of the Campaign hereunder only.
  10. Each Successful Referral will receive notification after the Referral Reward has been credited into their respective “YONOPay” e-Wallet.
  11. The Referral Reward may be used to perform any transaction on the YONO SuperApp, except for: –
    (a) Sending money; and
    (b) Transferring out to any bank account
  12. The Eligible Customer shall at all times ensure that they comply with the provisions of the Personal Data Protection Act 2010 (“PDPA 2010”) and its regulations, by-laws, codes of practice or requirements including but not limited to the processing and management of the personal data of the data subject, i.e. the referrals, that may be issued from time to time by the relevant governmental or regulatory authorities. For clarification purposes, any reference to “personal data”, “data subject” and “data processing” shall carry the same definition as provided for in the PDPA 2010. Pursuant to this, the Eligible Customer shall at all times fully comply with the
    following: –
    (a) The Eligible Customer shall treat the personal data of the referrals as confidential information;
    (b) The Eligible Customer shall not transfer any personal data of the referrals to any third party under any circumstances for any reason without the prior written consent of the Bank;
    (c) The Eligible Customer shall only use and/or process the personal data of the referrals strictly in accordance with this Campaign or as is necessary to fulfil your obligations and purposes under this Campaign;
    (d) Where the personal data of the referral is required to be transmitted or transferred outside Malaysia for the purposes of performance of this Campaign, you shall not cause or permit the same to be done without the prior written consent of BIPSB;
    (e) The Eligible Customer shall cooperate with BIPSB to enable the monitoring of the compliance with the obligations as set out in this Campaign and/or the PDPA 2010 including but not limited to permit the representatives of BIPSB the access to any premise where the personal data of the referral is being processed in order to ascertain compliance with this Programme and/or the PDPA 2010 upon reasonable notice being given to you prior to it;
    (f) The Eligible Customer shall forthwith inform BIPSB in writing upon becoming aware of any unauthorised use or disclosure of the personal data of the referral; and
    (g) The Eligible Customer shall take appropriate security measures to protect the personal data of the referral against accidental or unlawful destruction or accidental loss, alteration, unauthorised disclosure or access and against all other unlawful forms of processing.
  13. The Eligible Customer undertake to ensure that the consent of the potential referrals have been obtained before they are referred or introduced to the Bank.
  14. The Eligible Customer shall fully indemnify and keep BIPSB fully indemnified at all times from and against any and all losses, damages, actions, proceedings claims, demands, costs, expenses and/or liabilities including solicitors fees (on a “solicitor-client” basis) as may be incurred, sustained and/or suffered by BIPSB due to and/or arising from the breach, non-compliance and/or non-observance of any one or more of your covenants, undertakings, obligations, duties and/or responsibilities under and/or in connection with this Campaign.
  15. The Eligible Customer obligations under this Campaign shall survive the expiry or termination (as the case may be) of this Campaign.
  16. By participating in this Campaign, Eligible Customer hereby give their unequivocal and irrevocable consent and authorises BIPSB to disclose their particulars to any third party service provider engaged by BIPSB for the purpose of this Campaign.
  17. BIPSB shall not be responsible for any technical failures of any kind, whatsoever intervention, interruption, electronic error and/or any failure or delay in the transmission of evidence by postal or telecommunication authorities or any other party which may affect Eligible Customers’ entitlement during the Campaign Period.
  18. By participating in this Campaign, Eligible Customer hereby give their unequivocal and irrevocable consent and authorise BIPSB to use, publish and/or display the names, any photographs taken, any videos recorded and/or other information for current and future advertising and/or promotion relating to this campaign purposes only without any compensation.
  19. BIPSB reserves the right to withdraw/cancel, terminate, suspend or extend this Campaign and to add, delete, suspend or vary these Campaign Terms and Conditions, wholly or in part at its discretion with prior notice by any means of notification which BIPSB may select and such shall be binding on Eligible Customer as from the date of the notification or from such other date as may be specified by BIPSB in the notification. Eligible Customer agree to access these Campaign Terms and Conditions and agreed with and be bound by any addition, deletion, suspension or variation to these Campaign Terms and Conditions.
  20. The Bank reserves the right to disqualify the participation of any Eligible Customer or forfeit the Referral Reward in circumstances where there is a fraudulent, unauthorised or reversal of transaction(s) or breach or potential breach of these Campaign Terms and Conditions at its discretion. All findings of BIPSB on the transaction(s) made shall be conclusive and final.
  21. For the avoidance of doubt, any cancellation, termination, suspension or extension of this Campaign or disqualification of Eligible Customer or forfeiture of the Referral Rewards shall not entitle Eligible Customer to any claim or compensation against the Bank or for any and all losses or damages suffered or incurred by Eligible Customer as a direct or indirect result of the act of cancellation, termination, suspension, extension, and disqualification or forfeiture due to customer own act.
  22. BIPSB shall not be responsible nor shall accept any liabilities of whatsoever nature howsoever arising or suffered by Eligible Customer resulting directly or indirectly from this Campaign. BIPSB shall not be liable or held responsible to Eligible Customers in any manner whatsoever if BIPSB is unable to perform any of its obligations under this Campaign directly or indirectly due to any force majeure event which include but not limited to any act of God, war, strike, riot, industrial dispute, lockout, fire, drought, flood, storm or any event beyond the reasonable control of BIPSB.
  23. These Campaign Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia and Eligible Customer agrees to submit to the exclusive jurisdiction of the Courts of Malaysia.

YONO Spending Cashback Campaign

INTRODUCTION

This Campaign is held by Borneo Integrated Pay Sdn. Bhd. (Company No. 202101027893 / 1428193-H) (“BIPSB”). By participating in the Campaign, Merchant (as hereinafter defined) hereby agrees to be bound by these terms and conditions which shall form an integral part of and to be read together with YONO Terms and Conditions, YONOPay Terms and Conditions, and YONO Merchant Terms and Conditions.

In the event of a conflict or inconsistency between these terms and conditions, such inconsistency shall be resolved by giving precedence in the following decreasing order (i) these terms and conditions; (ii) YONO Terms and Conditions; (iii) YONOPay Terms and Conditions; and (iv) YONO Merchant Terms and Conditions.

Campaign Period

  • 15 September 2024 until 17 September 2024

Eligibility

  • This Campaign shall be applicable to all YONO merchants that participate in the Foh Sang Mooncake Festival 10% Cashback Campaign.

Campaign Mechanics

  1. During the Campaign Period, YONO User who spends at the eligible participating Merchant’s and pays by using YONO Superapp (“Transaction”) will be entitled to enjoy a 10% cashback per Transaction (“Reward”).
  2. The utilization of the Rewards is only limited to up to Ringgit Malaysia Nine Thousand only throughout the Campaign Period, on a first-come, first-served basis.
  3. No minimum spend is required to utilize the Reward, but the Reward may only be utilized when making a transaction at any YONO merchants and make payment with YONO Superapp only.
  4. At the end of Campaign Period, the total eligible Transactions will be identified and the total Reward entitled to be received by the eligible Merchants (so identified) will be credited into the eligible Merchants’ bank accounts registered with BIPSB within ninety (90) working days after the end of the Campaign Period.

General Campaign Terms and Conditions

  1. Transactions made after the expiry of the Campaign Period are considered invalid and will not be considered for this Campaign.
  2. BIPSB reserves the sole and absolute right to withdraw, amend, omit and/or vary any part or the whole of the terms and conditions of this Campaign without prior notice to the Merchant and Merchant shall be bound to observe, perform and comply with the terms and conditions herein and any amendments thereof.
  3. BIPSB reserves the right to check and verify the transactions made by YONO user to the eligible Merchant(s). BIPSB may disqualify and/ or blacklist you if you are suspected of engaging in suspicious transactions using the Boost mobile application.
  4. BIPSB’s decisions in any matter in relation to the Campaign shall be final and conclusive.
  5. BIPSB will not ask for any banking details such as credit card/ debit card number and bank transaction authorization code (TAC), YONO account password, PIN or one-time password (OTP) for the winners to claim the prize or for any reason whatsoever. Please do not share your banking details with anyone.
  6. BIPSB shall not be liable for any claim by Merchant or third-party claims or losses of any nature, including but not limited to, loss of profits, punitive, indirect, special, incidental, or consequential damages or for other damages and any related claims of any nature, including direct, indirect, third party, consequential or other damages resulting from or in connection with the Campaign.
  7. BIPSB shall not be liable for loss or damage to property or any personal injury or loss of life resulting from or in connection with the Campaign.
  8. Merchant acknowledges and agrees that BIPSB reserves the rights to forfeit any Incentive given to the Merchant if (i) the Merchant is found or suspected of tampering with the Campaign mechanics or the operation of the Campaign; (ii) the Merchant is found or suspected of undertaking fraudulent activities or other activities harmful to the Campaign; or (iii) the Merchant is in breach of its obligations or any terms and conditions of the Campaign. Notwithstanding the above, BIPSB reserves the right to reject any participation or the Merchants at its sole and absolute discretion without assigning any reasons whatsoever.
  9. BIPSB does not take any responsibility in the event the Merchant is prevented from participating in the Campaign, as a result of certain technical restrictions or other limitations specific or force majeure which including but not limited to regulatory and/or government directive, act of God etc.
  10. BIPSB disclaims any liability arising from the products or services sold by the Merchants.
  11. All photographs, personal information and names submitted in the Campaign shall be the property of BIPSB.
  12. By participating in the Campaign, the Merchant has agreed to allow BIPSB, at its absolute discretion, to use the Merchant’s name, photographs, voice or video recordings and entries for publicity, advertising, trade or Campaign purposes in any media, without first obtaining any further consent nor making any payment whatsoever to the Merchant.
  13. Except as expressly mentioned herein, BIPSB shall not be responsible for any expenses and cost including out-of-pocket expenses related to or as a consequence of the Merchants participating in the Campaign.
  14. The content for the Campaign may be provided by a third party. BIPSB does not filter or edit such content. Merchant acknowledges that BIPSB is under no obligation to censor the content or information provided. BIPSB disclaims all liability in relation to the content provided.
  15. In the event any of the provision in these terms and conditions is invalid, illegal and unenforceable under any applicable law or by any reasons whatsoever, the legality and enforceability of the remaining provisions shall not be affected.
  16. No delay or indulgence by BIPSB in enforcing any terms or conditions herein shall constitute waiver by BIPSB of Merchant’s breach of these terms and conditions.

YONO New User Welcome Campaign

INTRODUCTION

By participating in the Campaign, Merchant (as hereinafter defined) hereby agrees to be bound by these terms and conditions which shall form an integral part of and to be read together with YONO Terms and Conditions and YONOPay Terms and Conditions.

  • This Campaign shall only be applicable to YONO users who are new to YONO and opens a YONOPay account with YONO within the Campaign Period (“Customers”).

Campaign Mechanics

  1. During the Campaign Period, Customers who have successfully signed up for and registered an e-wallet account with YONO will be eligible to receive a one-time new user reward of Ringgit Malaysia Ten (RM10) only (“Reward”).
  2. Upon successful redemption, a RM10 YONO New User Reward will be credited into the Customers’ account and be visible in their YONO App.
  3. The Reward is limited to the first 3,500 utilizations only and on a first-come firstserved basis.
  4. Each Customer may only be entitled to receive and utilize the Reward for a maximum of one time under this Campaign.
  5. The Reward shall be valid from receipt up to and until 17 September 2024 or until full usage/ utilization, whichever comes first. Any unutilized Reward shall expire and be forfeited automatically without notice and the Customer shall have no claim whatsoever against BIPSB.

  21.
